Introduction

The purpose of the proyect is the study of the service contracts and the main kind of services in order to propose rules and principles for a future regulation. The system codified in the Spanish Civil Code is not only short, but it is very old-fashioned. Therefore, it could be said that in practice there is a legal void in the field. This situation, which has been so for a long time, is currently particularly prejudicial due to the importance of the service sector for the Spanish economy; a sector that needs safe, flexible and clear rules which adequate to the present reality and gives confidence to consumers.


The proyect has, as its goal, to provide rules for service contracts: Rules to attend the needs required in practice. Rules adapting to the current trends in Comparative Law and in the European initiatives towards the harmonization of Private Law.


The purpose is to make a special analysis of the posible variety of service contracts following the steps of the European texts, in particular the Draft Common Frame of Reference (DCFR). With the base of these different analysis, which shall have to take into account the existing consumers regulation, and starting form the conclusions thereof, a series of rules and principles common to all service contracts shall be elaborated. The systematic studies on the subject are a goal on their own, but are also devoted to the construction of “General Provisions” of the service contract.


The ultimate goal of the proyect is to eleborate a proposal for the regulation of the contract of services and the possible specific kinds of contracts which can serve as an inspiration for the legislator when facing the reform of the Spanish Civil Code on this field. Such a proposal will integrate the rules for the protection of consumers which might be applicable, in order to provide coherence to the whole system.
